On Friday, May 18, the National Health Law Program (NHeLP) and Nebraska Appleseed filed a class action lawsuit alleging that the Nebraska Department of Human Services (DHS) excludes treatment for childen with autism. The lawsuit was filed on behalf of two children who were denied access to Applied Behavioral Analysis (ABA) treatment that was recommended by their doctors. The lawsuit alleges that these denials violate the federal Medicaid Act's Early Periodic Screening Diagnosis and Treatment (EPSDT) provisions and Title II of the Americans with Disabilities Act (ADA).
