Z.M. v. South Carolina Department Of Health & Human Services

The lawsuit was filed on May 18, 2018, against the South Carolina Department of Health and Human Services (SCDHHS). The named plaintiff alleges that the SCDHHS Medicaid reimbursement rates for applied behavior analysis (ABA) for children diagnosed with autism is so low that Medicaid-children diagnosed with autism and prescribed ABA are unable to obtain services. The named plaintiff was diagnosed at age four, and as of age six had been unable to obtain ABA because provider organizations have been unwilling to accept the state reimbursement rate.
