Interagency Agreement Between The U.S. Department Of Education & U.S. Department Of Health & Human Services Relating To Special Education & Rehabilitative Services

The agreement was announced on June 16, 2026. In it, the U.S. Department of Education (ED) transferred responsibilities for educating students with disabilities to the federal Department of Health and Human Services (HHS). The agreement is between the ED Office of Special Education and Rehabilitative Services (OSERS) and HHS. OSERS’ components, the Office of Special Education Programs and the Rehabilitation Services Administration, will partner with HHS. HHS committed to carryout the responsibilities of ED-OSERS to ensure that students with disabilities receive a free and appropriate public education . . .
