CMS Memo To State Survey Agency Directors Regarding Escrow & Independent Informal Dispute Resolution Process for Nursing Homes – ApplicableTo All Civil Money Penalties

The memo informed state nursing home survey authorities that for surveys conducted on or after October 1, 2013, nursing homes facing a civil monetary penalty due to any type of deficiency will be subject to escrow and entitled to request an independent informal dispute resolution process. States are not permitted to charge facilities for the independent informal review process. Revisit surveys associated with an original survey that took place prior to October 1 will not be subject to the new rule.
