The Florida Agency for Health Care Administration responded to queries from the public about placements for children with complex medical needs. The federal Department of Justice believes the state's practice of housing such children in nursing homes rather than in a community-based setting violates the Americans with Disabilities Act. This document provides an outline for how AHCA determines medical necessity as a factor in placements and the placement options.
