Florida AHCA & DCF Joint Response To DOJ Finding That Placement Of Children With Complex Medical Needs In Nursing Homes Violates ADA

On September 4, 2012, the federal Department of Justice (DOJ) informed the Florida Agency for Health Care Administration (AHCA) that placing children with disabilities in nursing homes because community capacity was lacking violated the Americans with Disabilities Act (ADA). In this letter, the state responds to the DOJ allegations. Florida stated that it disagrees with the allegations and complies with all regulations and laws regarding provisions of services to children and young adults.
