CMS Letter To National Health Law Program About Oklahoma HB 2899 Residency Requirement For Home-& Community-Based Services

The document was released on September 16, 2021. It is a letter from the Centers for Medicare & Medicaid Services (CMS) to the National Health Law Program, which had asked CMS to review a new Oklahoma law, House Bill 2899 that imposes a five-year residency requirement before an individual could apply for Medicaid home- and community-based waiver services (HCBS). CMS said the requirement violated Medicaid policy. The state is in the process of trying to clear its HCBS wait list of about 6,000 people . . .
