The lawsuit was filed on October 22, 2015 by the ACLU of Pennsylvania against the state Department of Human Services. It is a class-action complaint alleging that Pennsylvania wait times for forensic competency restoration services violate the civil rights of people with mental illness. Those waiting for a forensic bed at the state hospital are held in jail. Some of the plaintiffs have waited in jail longer than they would have if they had been convicted for their alleged crime.
