EEOC v. Honeywell International, Regarding Employee Wellness Program Violations Of The ADA & GINA
On October 27, 2014, the federal Equal Employment Opportunity Commission (EEOC) sued Honeywell International seeking to stop Honeywell from imposing surcharges on employees who refuse to submit to biometric testing as part of its wellness program. The EEOC said the testing violates the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA), due to the use of financial incentives to reward participation in the wellness program or to penalize non-participation . . .
