On January 28, 2013, the New York Department of Financial Services filed an emergency rule to define the health care professionals eligible to receive insurance reimbursement for providing applied behavior analysis (ABA) services to children with autism. In 2011, the state legislature adopted an insurance mandate requiring health insurers, for plans issued on or after November 1, 2012, to cover up to $45,000 annually for autism treatment, including applied behavioral analysis (ABA); however, the state lacked professional standards criteria for ABA.
