Makhnevich, alleges that privacy agreements used by health care professionals to prevent patients from posting negative consumer reviews of the care or service provided are misleading, constitute a breach of ethics, and are not valid under state law. Additionally, the plaintiff claims that comments posted to consumer rating websites are legally protected speech and fall under “fair use” copyright laws.
