Guidance For Public Housing Agencies & Owners Of Federally-Assisted Housing On Excluding The Use Of Arrest Records In Housing Decisions
On November 2, 2015, The Department of Housing and Urban Development (HUD) provided guidance to public housing authorities (PHAs) on the use of arrest records to deny admission to public housing or evict a person currently living in public housing. The guidance states that an arrest alone is not sufficient evidence to deny access to public housing. Additionally, the guidance discourages the use of "one-strike" policies for individuals living in public housing and provides best practices for admitting individuals with criminal convictions into public housing . . .
