On May 5, 2023, the United States Department of Justice Civil Rights Division published this report regarding the investigation of South Carolina’s use of adult care homes to serve adults with serious mental illiness. After an extensive investigation, the United States Department of Justice (DOJ) concludes there is reasonable cause to believe that the State of South Carolina violates Title II of the Americans with Disabilities Act (ADA), 42 U.S.C. § 12132, by failing to provide services to individuals with serious mental illness in the most integrated setting appropriate to their needs . . .
