DOJ Says Missouri Reliance On Institutional Care For Adults With Mental Disabilities Violates ADA
On June 18, 2024, the federal Department of Justice (DOJ) reported that the State of Missouri violates the rights of adults with mental disabilities by unnecessarily institutionalizing them in nursing facilities to access need support services, in violation of the Americans with Disabilities Act (ADA). The state also improperly relies on guardianship, and this results in people entering skilled nursing facilities (SNFs) even though community-based services are appropriate for their needs. The DOJ characterized the guardianships as “a pipeline to nursing facilities.” The DOJ and the state are working to resolve the violations.
