Nevada To Improve Community-Based Services For Children With Behavioral Health Disabilities
On January 3, 2025, the Nevada Medicaid program agreed to improve community-based services for children with behavioral health disabilities so that they can access services without being institutionalized. The agreement settles a federal lawsuit filed the same day by the Department of Justice (DOJ) which alleged that its investigation found the state violated the Americans with Disabilities Act (ADA) and the Supreme Court’s decision in Olmstead v. L.C. by unnecessarily segregating children with behavioral health disabilities in institutional settings like hospitals and residential treatment facilities.
