Department Of Labor Withdraws Proposal To End Subminimum Wage For Workers With Disabilities

On July 7, 2025, the U.S. Department of Labor (DOL) Wage and Hour Division (WHD) withdrew its proposal to end the practice of issuing 14(c) certificates to allow employers to pay subminimum wages to workers whose earning or productive capacities are impaired by a physical or mental disability, including those related to age or injury. The earlier proposal was released on December 4, 2024. After analyzing the proposal and other policies, the DOL stated that it lacks statutory authority under the Fair Labor Standards Act (FLSA) to unilaterally terminate the practice.;
