Preliminary Injunction In Rivera v. Douglas

On January 20, 2015, the Alameda County Superior Court ruled that if the California Department of Health Care Services (DHCS) is unable to determine whether an applicant is eligible for Medi-Cal (Medicaid) within 45 days, it must grant that applicant temporary Medicaid benefits. The ruling was in response to Rivera v. Douglas a class action lawsuit filed on behalf of Medi-Cal applicants waiting more than 45 days for DHCS to determine their eligibility for Medi-Cal. DHCS has a backlog of more than 50,000 applications waiting for a determination . . .
