Idaho Sued Over Developmental Disability Waiver Services Budget Change, Class Action Status Sought
A group of 13 Idaho residents with developmental disabilities are suing the Idaho Department of Health and Welfare (IDHW) over a change to how the state calculates Medicaid waiver service budgets and notifies beneficiaries. The group of plaintiffs filed their complaint in 2012; in May 2013, they filed a motion seeking class action status for the complaint. The plaintiffs seek to force IDHW to restore service budgets to the 2011 level. If approved by the court, the class would include nearly 3,600 individuals with developmental disabilities who receive services through the Developmentally Disabled Medicaid Waiver program.
