Lawsuit Alleges Discrimination In Indiana’s Housing Requirements For People With I/DD

On March 14, 2017, New Horizons Rehabilitation Inc., which provides services for people with intellectual and developmental disabilities (I/DD), sued the Indiana Department of Homeland Security (IDHS). The lawsuit alleged that DHS requirements for housing for people with I/DD are discriminatory. The provider organization alleges that the additional IDHS requirements place undue burden on New Horizons and fail to accommodate its clients, violate the Equal Protection Clause of the 14th Amendment to; the Fair Housing Amendments Act; the Rehabilitation Act; and the Americans with Disabilities Act. IDHS enforces building and fire codes statewide.
