Florida Case Challenging Nursing Home Placements For Children With I/DD Going To Federal Court
On August 8, 2017, attorneys for plaintiffs in lawsuit challenging the Florida Medicaid program’s use of nursing home placements for children with intellectual and developmental disabilities (I/DD) rather than community placements, gave notice that they will appeal to the U.S. Circuit Court of Appeals. The case is A.R., et al, v. Secretary of the Florida Agency for Health Care Administration, which was filed in 2013. The complaint alleged that placing children with disabilities in nursing homes violated the Americans with Disabilities Act (ADA) because the state failed to provide services and supports to children with disabilities . . .
