Missouri Lawsuit Over Foster Youth Use Of Psychotropics Will Move Forward

On January 8, 2018, a federal court rejected a Missouri motion to dismiss a class-action suit that challenged the state’s oversight of children in the foster care system prescribed psychotropic drugs. The plaintiffs seek declaratory and injunctive relief. The state asked the court to dismiss the complaint. The court agreed to dismiss part of the complaint, but denied the request to entirely dismiss it. The complaint’s allegation that the state’s policies violate due process will move forward.
