Judge Rules That ADA Applies To Brookdale Assisted Living Communities In California

On January 25, 2019, a federal court ruled that the Americans with Disabilities Act of 1990 (ADA) applies to assisted living facilities operated by Brookdale Senior Living in California. The plaintiffs in the case are residents of Brookdale Senior Living facilities. The plaintiffs sued in July 2017 alleging Brookdale’s assisted living staffing was insufficient and the facilities are not accessible by persons with disabilities, which prevents residents with disabilities from fully accessing and enjoying the facilities.

The ruling was in “Stiner v. Brookdale Order On Motions-To Compel Arbitration.” The plaintiffs’ attorneys believe this is the first class-action . . .
