New Mexico Reaches Settlement In Long-Running Jackson I/DD Class Action Lawsuit
On April 18, 2019, the State of New Mexico settled a lawsuit filed in 1987 over services for people with intellectual/developmental disability (I/DD). The settlement in Jackson, et al., vs. the Los Lunas Center for Persons with Developmental Disabilities, et al., calls for the state Department of Health (DOH) to demonstrate full compliance with the settlement, but the state will be permitted to operate under its current policies and rules without outside oversight or direction. The state will continue to be responsible for meeting the health and safety needs of individuals with I/DD.
