New Oregon Law Supports Medical Decisionmaking For Adults With Developmental Disabilities

Newly signed legislation in Oregon is intended to ensure that medical decisions can be made for adults with developmental disabilities. Oregon Senate Bill (SB) 1039 codifies the state’s process for appointing medical decisionmakers for this population. It was signed on June 20, 2019. The Oregon Department of Human Services (DHS) will propose rules during the fall of 2019. The law goes into effect on January 1, 2020.

Previously, the state had no law that explicitly authorized any specific system to guide medical decisionmaking for adults with developmental disabilities. This law authorizes DHS to use its existing system.
