August 19, 2002Florida Court Bars Use of School Vouchers Citing Florida's constitutional prohibition on state-funded religious education, a Leon County circuit declared Florida's statewide school voucher program unconstitutional on August 5, 2002. In Ruth Holmes v. Jeb Bush, Leon County Circuit Court, Judge P. Kevin Davey cited Article 1, Section 3 of the Florida Constitution, which states that: "No revenue of the state or any political subdivision or agency thereof shall ever be taken from the public treasury directly or indirectly in aid of any church, sect, or religious denomination or in aid of any sectarian institution . . .
