California Implements County Caps On The Number Of Defendants Deemed Incompetent To Stand Trial

The California Department of State Hospitals (DSH) is implementing a recent law change as part of its Incompetent to Stand Trial (IST) Solutions Program twhich sets a growth cap on how many individuals with mental illness the counties can determine to be IST and refer to a state hospital bed for competency restoration services. The cap was included in California Senate Bill 184: Health. The goal of the growth cap is to help ensure that the expansion of DSH-funded community-based competency restoration does not create unintended incentives that result in an increased number of individuals being found IST . . .
