California To Move An ICF-DD Setting From Waiver To State Plan To Comply With Federal HCBS Settings Final Rule
The California Department of Health Care Services (DHCS) is developing a state-plan amendment (SPA) to move one of its Intermediate Care Facility (ICF) housing settings for people with intellectual/developmental disabilities (I/DD) from waiver coverage to become a state plan benefit. The stated reason is that the setting does not comply with federal rules governing home and community-based services (HCBS) that were finalized in March 2024. The rules require HCBS to be delivered in integrated, community-based settings that support individual choice and autonomy regarding visitors, nutrition, and personal resources. ;
