Class-Action Lawsuit Filed Against Utah By Individuals Living In Private Intermediate Care Facilities

On January 8, 2018, Staci Christensen, John R. Weakly, Disability Law Center filed a class action lawsuit against the state of Utah, including the Utah Department of Health, the Division of Services for People with Disabilities, and Governor Gary Herbert on behalf of consumers with intellectual and developmental disabilities (I/DD). The plaintiffs allege that the individuals with I/DD living in private ICFs are not given access to integrated community-based services and are denied the choice to make meaningful and informed choices about segregation as decided under the Olmstead decision.
