CMS Abandons Nursing Home Arbitration Appeal

On June 8, 2017, the Centers for Medicare & Medicaid Services (CMS) released a proposed rule stating that it plans to abandon rules restricting nursing homes from requiring residents to agree to mandatory arbitration as a condition of residency. On June 2, 2017, CMS said it was abandoning its efforts to appeal a legal ruling issued by a federal court in November 2016 that blocked CMS from implementing a new rule issued in October 2016 that would have prevented long-term care facilities from requiring incoming residents to agree to pre-dispute arbitration.
