On March 18, 2023, the Centers for Medicare & Medicaid Services (CMS) fully implemented its rules on the types of long-term care living arrangements that qualify as an appropriate setting for Medicaid-funded home- and community-based services (HCBS). The rules, originally issued in January 2014, is intended to ensure that Medicaid beneficiaries receiving HCBS are living in community-based settings, not institutional settings, such as skilled nursing facilities or segregated group homes.
