Disability Rights Of West Virginia Sues State Over Failure To Schedule I/DD Waiver Individual Budget Appeals

On March 17, 2017, Disability Rights of West Virginia (DRWV) sued the state contending that the Department of Health and Human Resources (DHHR) has been refusing to set hearing dates for individual budget appeals filed by people with intellectual or developmental disabilities (I/DD) who are receiving Medicaid waiver services. At the same time, DRWV filed for an injunction. The state has until May 18, 2017, to respond to the injunction.
