DOL Proposes Rolling Back Minimum Wage, Overtime Rules For Hospice, Home Health Aides
In a proposed rule, the federal Department of Labor (DOL) stated its intent to exempt;hospice, home health, and personal care workers from eligibility for minimum wage rules and overtime benefits. The proposed rule was posted on July 2, 2025. DOL will accept public comments until September 2, 2025. More than 3.7 million workers could be affected if the rule is enacted as proposed. DOL has required third-party home care agencies, including state Medicaid programs, to pay these employees at least the federal minimum wage and overtime when appropriate since 2013.
