Feds To Kansas: Halt Implementation Of New ‘Capable Person’ Policies For HCBS Waiver

In September 2016, the federal Centers for Medicare & Medicaid Services (CMS) rejected the Kansas Department for Aging and Disability Services (KDADS) plans to change its “capable person” policy for home- and community-based services (HCBS) for people with intellectual and developmental disabilities (I/DD). CMS said the changes KDADS sought were not parallel with the state’s other HCBS waivers and advised KDADS to align the policies.
