Feds Say Oklahoma’s New Five-Year Residency Pre-Requisite For I/DD HCBS Is Unconstitutional
On September 16, 2021, the Centers for Medicare & Medicaid Services (CMS) said that Oklahoma’s new five-year residency requirement for Medicaid home- and community-based waiver services (HCBS) for people with intellectual/developmental disabilities (I/DD) is not permitted under federal law. Specifically, CMS said the “length of residency” requirement is unconstitutional. The state Medicaid agency has requested technical assistance on the issue of its waiting list concerns.
