HUD Proposes Mandatory Immigration Status Verification For All Residents In Assisted Housing

The U.S. Department of Housing and Urban Development (HUD) issued a proposed rule on February 20, 2026, that would require all residents in HUD-funded housing to provide proof of U.S. citizenship or eligible immigration status. Public comments are due by April 21, 2026.

The proposed rule implements an executive order issued February 19, 2025, and would revise HUD’s Section 214 regulations governing eligibility for housing assistance.

HUD estimates that approximately 24,000 ineligible individuals in 20,000 “mixed status households” currently receive housing assistance. A recent audit conducted by HUD and the Department of Homeland Security . . .
