Indiana FSSA Violated ADA By Failing To Help Hospitalized Individual With Quadriplegia Return Home
On January 10, 2019, a federal judge ruled that the Indiana Family and Social Services Administration (FSSA) had violated the Americans with Disabilities Act (ADA) in failing to arrange for home health care for an elderly ventilator-dependent, Medicaid beneficiary with quadriplegia who had been confined to a hospital or nursing home since February 2016. The individual had previously lived independently, with home health care assistance, and since being cleared for discharge has desired to return home.
