Indiana Implementing Legislation To Regulate Non-Profit Hospital Pricing

Indiana is enacting two hospital pricing requirements under House Enrolled Act 1004 of 2025 that regulate how much non-profit hospitals can charge. Beginning in 2029, qualifying large non-profit hospital systems must keep their aggregate average commercial inpatient and outpatient prices at or below statewide averages established by the Indiana Office of Management and Budget (OMB) or forfeit their Indiana non-profit tax status for at least one year. Separately, the law requires hospitals to offer direct-to-employer health care arrangements priced at or below 260% of full Medicare payment.
