Indiana Parents Of Children With Disabilities Sue Over Medicaid Waiver Changes

After the Indiana Family and Social Services Administration (FSSA) announced changes to Medicaid attendant care services for children with medically complex disabilities, on May 17, 2024, parents of two children sued alleging that the changes violate the Americans with Disabilities Act (ADA) and federal Medicaid laws. The policy change, which goes into effect on July 1, 2024, will prohibit parents (and other Legally Responsible Individuals) from serving as paid providers of “attendant care” services through the Aged and Disabled Medicaid (A&D) Waiver program.
