Justice Department Sues Colorado For Segregating People With Physical Disabilities & Older Adults In Nursing Facilities
On September 29, 2023, the U.S. Department of Justice (DOJ) sued the State of Colorado for violating the Americans with Disabilities Act (ADA), alleging that the state unnecessarily segregates adults with physical disabilities, including older adults, in nursing facilities. According to the DOJ, approximately 9,000 institutionalized individuals live in Colorado nursing facilities. The DOJ estimates about 13% have low care needs, meaning that they require only a few hours of personal care services per day or week to help with medication management, grooming, housekeeping, shopping, and meal preparation.
