Court Ruling Makes Changes To New Jersey Medicaid Estate Recovery Rules
On March 11, 2021, a New Jersey Court ruled on a case that changes Medicaid estate recovery rules that apply to older adult who receives Medicaid-funded long-term care. The ruling was in A.M. v. Monmouth County Board of Social Services. The plaintiff is the adult child of a now deceased beneficiary who had been admitted to a nursing home. The adult child lived with the beneficiary and was the primary caregiver prior to nursing home admission.
