New Mexico Cannabis Dispensary Sues Insurers For Coverage Of Cannabis Treatment
On June 1, 2022, New Mexico Top Organics-Ultra Health, a medical cannabis dispensary, and individual plaintiffs sued Blue Cross & Blue Shield Of New Mexico and other health plans in the state to seek a determination that medical cannabis is a covered health care service for treatment of behavioral health conditions. Under a state law that went into effect on January 1, 2022, the cost of behavioral health services, including medications, must be fully covered by insurance without a deductible or other cost sharing.
