Recovery Centers Of America Sues New Jersey Township For Denying Approval Of Treatment Facility
On October 6, 2015, Recovery Centers of America (RCA) sued Gloucester Township, New Jersey alleging that the planning board violated the federal Fair Housing Act and the Americans with Disabilities Act (ADA) when it denied RCA’s proposal for a 37-bed residential addiction treatment facility at an appropriately zone site. The lawsuit, filed by RCA affiliate 1840 Peter Cheeseman Road LLC, (the location of the proposed facility) alleges that the board’s decision to deny the application despite evidence that the project complied with all requirements was “arbitrary, capricious, and unreasonable” and driven by negative public opinion about addiction . . .
