Federal Court Nixes DOL Minimum Wage Rule For Non-Medical Home Care Workers
On January 14, 2015, the second of two rulings in a legal challenge to the Department of Labor (DOL) Home Care Final Rule effectively invalidated the rule in its entirety; the rule, slated to go into effect on January 1, 2015, will not go into effect. The Home Care Final Rule required home care provider organizations to pay caregivers providing non-medical services minimum wage and overtime; it limited the provider organizations' use of an exemption to the Fair Labor Standards Act (FLSA) for companionship services.
