On August 22, 2023, three former Florida Medicaid beneficiaries represented by two advocacy organizations, sued the Florida Agency for Health Care Administration (AHCA) and the Department of Children and Families (DCF) alleging that the state’s Medicaid redetermination notices are inadequate. The plaintiffs allege that the notices lack information about how an individual can challenge a termination to obtain a pre-termination fair hearing. The plaintiffs asked the court for an injunction to prevent the state from terminating Medicaid beneficiaries until the state revises the notices and provides an opportunity for pre-termination hearings.
