Supreme Court Decision Allows Students To Sue Schools More Easily For Disability Discrimination
On June 12, 2025, the Supreme Court of the United States ruled unanimously that students with disabilities do not need to prove “bad faith or gross misjudgment” to pursue education discrimination cases against schools. Student claims against schools in violation of the Americans with Disabilities Act (ADA) and the Rehabilitation Act should be subject to the same standards that apply in other disability discrimination contexts, according to the ruling. The decision reverses an Eighth Circuit court ruling that sided with the school district, which said that discrimination cases in the context of education must meet a higher legal standard.
