Home Care Minimum Wage & Overtime Rules To Move Ahead With Supreme Court Decision

On June 27, 2016, the Supreme Court decided not to hear Home Care Association of America, et al. v. Weil, which challenged a rule by the Department of Labor (DOL) requiring third-party home care provider organizations to pay federal minimum wage and overtime to home care workers. As a result, the DOL will continue to implement and enforce the rule, which went into effect on October 13, 2015.

The DOL “Home Care Rule” ends the “companionship exemption” in the Fair Labor Standards Act (FLSA), and it states that third-party employers may not avail themselves of exemptions from minimum . . .
