On March 23, 2021, the Michigan Department of Health and Human Services (MDHHS) announced plans to permanently ban the use of physical restraints and seclusion in child-caring institutions for children in foster care. In July 2020, MDHHS had implemented temporary emergency rules restricting the use of restraints in these settings. The rules have been filed and were approved by Michigan Office of Administrative Hearings and Rules (MOAHR) on March 18, 2021. An MDDHS spokesperson said a public hearing date has not yet been published, but MDDHS anticipates the hearings will occur in May 2021.
