Parity Redux
Just this week, an appellate court overturned what was considered a landmark ruling on mental health parity against United Behavioral Health (UBH)—a subsidiary of UnitedHealthcare that manages the behavioral health benefits for the health plan (see Appeals Court Overturns Ruling Against UnitedHealth In Landmark Mental Health Parity Class Action and UnitedHealth Group Wins Reversal In Landmark Case On Behavioral Health Coverage). In this latest ruling, the court decided that UBH “was not unreasonable” in issuing of coverage denials because it was not required to cover all the services in question under the ‘generally accepted standards of care'.
