26 States Sue To Block Medical Frailty Provisions In Interim Medicaid Work/Community Engagement Rules

A coalition of 26 states is suing to challenge the Centers for Medicare & Medicaid Services (CMS) definition of medical frailty in its implementation of new Medicaid work requirements included in the One Big Beautiful Bill Act (OBBBA) of 2025. The lawsuit was filed on June 29, 2026.

Under the OBBBA, by January 1, 2027, the 43 states and the District of Columbia that expanded Medicaid must ensure that non-exempt beneficiaries ages 19 to 64 are working, volunteering, or participating in other approved activities for at least 80 hours per month to remain eligible for Medicaid.
