HHS Blocked On Further Implementation Of 340B Drug Pricing Program Rule On Resolving Disputes Between Manufacturers & Safety Net Provider Organizations Using Contract Pharmacies
On March 16, 2021, a judge blocked the federal Department of Health and Human Services (HHS) from implementing a rule on administrative dispute resolution (ADR) for the Medicare 340 B Drug Pricing Program, which require pharmaceutical firms to offer discounts on drugs to safety net provider organizations in exchange for Medicare coverage. The judge issued a preliminary injunction in Eli Lilly & Company, et al. v. Norris Cochran, et al., which challenged the implementation process for the rule.
